Acceptance of Terms

Welcome to ROVmap ("Company," "we," "us," or "our"). By accessing or using our website at rovmap.com, our mobile applications, APIs, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, you must not access or use our Services. These Terms apply to all visitors, users, and anyone who accesses the Services.

Use of Services

ROVmap provides interactive mapping, location-based data, route planning, and related geospatial services. We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal or internal business purposes, subject to these Terms.

Permitted Uses

• Accessing and viewing maps and location data for lawful purposes
• Using navigation features for personal or commercial route planning
• Integrating our APIs into your applications in accordance with our API Terms
• Sharing map links via our built-in sharing features

Prohibited Uses

• Scraping, harvesting, or bulk downloading map data without written consent
• Reverse engineering or decompiling any part of our Services
• Using the Services to track individuals without their explicit consent
• Reselling or sublicensing access to our data or Services
• Circumventing rate limits, access controls, or security measures

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. We will not be liable for any modification, suspension, or discontinuance.

User Accounts

To access certain features of our Services, you may be required to create an account. When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password used to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account at security@rovmap.com.

You may not use as a username the name of another person or entity, or a name that is not lawfully available for use, or a name or trademark subject to any rights without appropriate authorization.

User Conduct

By using our Services, you agree to comply with all applicable laws and regulations and not to engage in any conduct that restricts or inhibits any other person from using or enjoying the Services.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any regulations
• Post or transmit any content that is harmful, offensive, or infringes third-party rights
• Impersonate any person or entity or misrepresent your affiliation
• Introduce viruses, trojans, worms, or other malicious software
• Engage in any activity that interferes with the proper working of the Services
• Attempt to gain unauthorized access to any part of the Services or its related systems
• Use the Services to collect or store personal data about other users without permission

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing offending content and terminating accounts.

Intellectual Property

The Services and their original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of ROVmap and its licensors. Our Services are protected by copyright, trademark, and other laws of both the Netherlands and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ROVmap. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our proprietary content without our express written consent.

User Content

If you submit, upload, or otherwise make available any content through our Services ("User Content"), you grant ROVmap a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Services. You represent and warrant that you own or have the necessary rights to grant this license.

Third-Party Services

Our Services may contain links to third-party websites or services that are not owned or controlled by ROVmap. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

ROVmap uses third-party map data providers, satellite imagery providers, and traffic data services to power its platform. The availability and accuracy of this data is subject to those providers' own terms and may vary by region.

Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

ROVmap does not warrant that: (i) the Services will be uninterrupted or error-free; (ii) the results obtained from using the Services will be accurate or reliable; (iii) map data, routing suggestions, or location information will be current, complete, or suitable for navigation in safety-critical situations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROVMAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if ROVmap has been advised of the possibility of such damage.

In jurisdictions that do not allow the limitation of liability for consequential or incidental damages, ROVmap's liability shall be limited to the maximum extent permitted by law. Our total liability to you for all claims shall not exceed the amount you paid to ROVmap in the twelve (12) months preceding the claim, or €100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless ROVmap and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees).

This indemnification applies arising from or related to:

• Your use of and access to the Services
• Your violation of any term of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit through the Services
• Your violation of any applicable law or regulation

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

If you wish to terminate your account, you may simply discontinue using the Services or contact us at support@rovmap.com to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, Netherlands. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
